
Gov’t tightens air pollution control with ordinance update
The amended ordinance now includes marine operations under licensing rules.
The government has implemented the Air Pollution Control (Amendment) Ordinance 2025 to update the Air Quality Objectives (AQOs) and strengthen regulations on unlicensed specified process (SP) operations.
The amendment tightens five existing AQOs and adds three new parameters introduced by the World Health Organization (WHO) to the WHO Global Air Quality Guidelines.
To accommodate ongoing developments, transitional arrangements are in place for projects with environmental permits (EPs) issued before 11 April. If EP variations are filed within 36 months from the implementation of the amendment ordinance, pre-amended AQOs will apply.
Meanwhile, unlicensed SP operations may be issued a closure notice. Failure to comply will result in a maximum fine of $1m and 12 months imprisonment.
In addition, the amendment also expands the definitions of “cement works” and “premises” to include operations on ships and barges under SP licensing control.
The Environmental Protection Department (EPD) will issue a six-month grace period for cement operators to apply for SP licences.
