Hong Kong top court affirms same-sex spouses' housing rights

Two judicial reviews concerned rights under public rental housing and the Home Ownership Scheme.

Hong Kong’s top court has ruled in favour of same-sex spouses’ housing rights, deeming the Housing Authority’s (HA) policies “unconstitutional.”

The ruling, delivered on November 26, involved two judicial reviews brought by Nick Infinger and Li Yik Ho.

The judicial reviews concerned the rights of same-sex spouses under the HA's public rental housing and Home Ownership Scheme policies, respectively.

A spokesperson for the HA said it respects the judgment and will review the ruling with legal counsel for potential follow-up actions.
