
New exemption option for columbaria as amendment takes effect
After obtaining an exemption, sellers can retain the niches they sold.
The Private Columbaria Amendment, which takes effect on 2 June, now provides “pre-cut-off columbaria” with an additional route to apply for exemption.
“Pre-cut-off columbaria” were in operation and had ashes interred in them before the proposal to establish a licensing regime last June 2014.
After obtaining an exemption, sellers can retain the niches they sold before the enactment of the ordinance.
The amendment also enhances enforcement-related provisions for a greater deterrent effect, including new offences prohibiting overselling niches and over-placing ashes.
Additionally, it requires the Private Columbaria Appeal Board to only receive and consider new materials not previously provided to the Licensing Board upon special grounds.
