Labour Department revokes licence of JB Employment Agency in Kwun Tong

This marks the first instance of an EA licence being revoked in 2024.

The Labour Department (LD) has announced the revocation of the employment agency (EA) licence held by JB Employment Agency in Kwun Tong due to multiple violations of the regulatory Code. 

The decision follows the agency's failure to adhere to several key requirements, including not drafting service agreements with employers while providing services, failing to provide receipts for service fees charged to employers, and neglecting to inform employers about laws relevant to the employment of foreign domestic helpers (FDHs) and their associated rights and obligations. 

Additionally, JB Employment Agency did not supply employers with essential materials such as guidebooks, leaflets, and sample forms outlining the rights and benefits of FDHs, nor did it obtain written confirmation from employers acknowledging receipt of the signed original standard employment contracts.

According to Section 53(1)(c)(iva) of the Employment Ordinance (Cap. 57), the Commissioner for Labour can revoke an EA licence if compliance with the Code is not met. 

A spokesperson for the LD stated, "The Code sets out the salient legal requirements that EA operators must observe in operating their business, as well as the standards which the Commissioner expects from EAs. The Employment Ordinance stipulates that the Commissioner may refuse to issue or renew a licence, or may revoke a licence, if she is satisfied on reasonable grounds that the licensee has contravened any provisions of Part XII or any regulations made under Section 62 of the EO." 

The revocation marks the first instance of an EA licence being revoked in 2024.
