Mainland China, Hong Kong courts roll-out new civil, commercial arrangement
Judgements of civil and commercial matters made in one court will be recognized in both places.
Mainland China and Hong Kong have unveiled a new ordinance wherein judgements of civil and commercial matters made in either the Mainland or Hong Kong court will be recognized in both places.
This meant that parties will no longer need to re-litigate the same dispute in the Mainland and in Hong Kong courts, respectively, so long as the effective judgment is covered by the civil and commercial arrangement under the new ordinance.
The new mechanism applies to judgements given by Hong Kong and Mainland courts beginning 29 January 2024.
